Terms of Service

These Terms of Service (“Terms”) govern your use of ArmaTune Inc.’s (“ArmaTune,” “we,” “us,” or “our”) services, including any related websites, applications, and tools (collectively, the “Service”). ArmaTune is a Delaware corporation operating globally. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. Accounts and Access

You must create an ArmaTune account to use the Service. You must be at least 13 years old (or the minimum age in your jurisdiction) to register. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You may connect your social media or music service accounts (such as TikTok, YouTube, Instagram, Spotify, Apple Music, or other integrated platforms) to ArmaTune via OAuth. ArmaTune does not collect or store user API keys; we only use OAuth access tokens that you authorize. The tokens are used solely to post content on your behalf and retrieve analytics from your connected accounts. You agree to provide accurate, current information when creating or updating your account, and to notify us of any unauthorized use of your account.

Connected Services and Data Use

When you connect a third-party account (e.g. TikTok, YouTube, Instagram, etc.), you grant ArmaTune permission to retrieve data from that account. The types of data and services accessed depend on the platform and the permissions you grant. For example, ArmaTune may post content to your accounts and fetch performance analytics on your behalf. Performance analytics may include metrics such as video or post views, likes, comments, shares, watch time or average view duration (as permitted by the platform), and audience reach or demographic information (if available). These metrics are collected only with your authorization and are used to help you measure and improve your content performance.

You agree not to use ArmaTune in any way that violates the terms or policies of any connected platform. For example, you must comply with all applicable laws and with each platform’s terms of use, community guidelines, and developer policies (e.g. TikTok’s policies). Do not post illegal, infringing, or offensive content through our Service. We may remove or refuse to publish any content that violates these rules or that we deem inappropriate.

AI Tools Disclaimer: ArmaTune may use AI-assisted editing tools to help improve or format your content. “AI-assisted editing” refers to the use of artificial intelligence tools to enhance content quality. However, ArmaTune is not a generative AI content creation platform; all creative content remains your own or provided by you. We simply provide tools (some AI-powered) to assist with editing or processing your content.

Subscription, Billing, and Refunds

ArmaTune is a subscription-based service. Subscriptions are billed in advance on a monthly or annual basis, as selected at signup. You authorize us (or our payment processor) to charge the payment method you provide on a recurring basis until you cancel. You may cancel your subscription at any time through your account settings. Cancellations will take effect at the end of the current billing cycle. Refunds are granted only as provided in this agreement. Except where required by law, we generally do not offer refunds for partial periods of service. If you believe you are entitled to a refund, please contact us at info@arma-tune.com.

Intellectual Property

ArmaTune and its licensors retain all right, title, and interest in the Service, including software, tools, and content (excluding your content) provided through the Service. You retain ownership of the content you upload or create. By posting content through ArmaTune, you grant ArmaTune a worldwide, non-exclusive, royalty-free license to use, store, and transmit that content as necessary to provide the Service to you. You are solely responsible for the content you create, post, or upload, and you represent that you have all rights necessary to use it on our Service.

Termination

You may stop using the Service at any time. ArmaTune may suspend or terminate your access (or the Service) at its discretion if you violate these Terms or if you engage in illegal or abusive behavior. Upon termination or cancellation, your rights under these Terms will end, but any provisions that by their nature should survive (such as intellectual property rights, payment obligations, disclaimers, limitation of liability, and dispute resolution) will survive.

Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. No warranties: ArmaTune makes no warranties of any kind, express or implied. We do not guarantee that the Service will be secure, error-free, or uninterrupted. All content and features are provided for general informational purposes only. You understand and agree that any content or data we provide (such as analytics or recommendations) are given for your convenience and guidance, not guarantees of performance or results. You use the Service at your own risk.

Limitation of Liability

To the maximum extent permitted by law, ArmaTune (and its officers, directors, employees, agents, and affiliates) will not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to, lost profits, loss of data, downtime costs, or any damages arising from your use of the Service, even if we were advised of the possibility of such damages. In no event will ArmaTune’s total liability for any claim related to the Service exceed the amount you paid ArmaTune in the twelve (12) months prior to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so this limitation may not apply to you in full.

Governing Law and Dispute Resolution

These Terms and your use of the Service are governed by and construed under the laws of the State of Delaware, without regard to conflict-of-law principles. You agree that any legal action or proceeding arising from or relating to these Terms or the Service shall be brought exclusively in the federal or state courts located in Delaware. You waive any objection to the personal jurisdiction of such courts.

Changes to Terms

We may modify these Terms from time to time (for example, to comply with new laws or platform policies). We will post a revised version with an updated date. Your continued use of the Service after any changes indicates your acceptance of the new Terms.
